These Terms of Service ("Terms") govern your access to and use of the website, applications, and related services operated by Dogmarket.ie ("Dogmarket", "we", "us", or "our") in Ireland. By creating an account, posting content, purchasing listings or subscriptions, or otherwise using our services, you agree to these Terms. If you do not agree, you must not use Dogmarket.
Nothing in these Terms is intended to limit any rights you may have under mandatory provisions of Irish or EU law, including consumer protection law, where those rights apply to you.
By registering, accessing, or using Dogmarket, you confirm that you have read, understood, and agree to be bound by these Terms and by any additional policies referenced here (including our Privacy Policy). If you use Dogmarket on behalf of a business, you represent that you have authority to bind that business. Your continued use after we post updated Terms constitutes acceptance of the changes, except where applicable law requires a different process.
Dogmarket.ie is an online marketplace and community platform focused on dogs in Ireland. We provide tools for listings, subscriptions, messaging, forums, and events.
That can include puppy and adult dog listings for sale or rehoming, usually with a one-time listing fee through Stripe Payment Links (currently about €40 per listing, and prices can change). It can include stud listings and service listings for vets, groomers, trainers, boarding, and pet shops on a subscription basis, plus account registration and verification, messaging between users, forum topics, and events.
Dogmarket is a facilitator only. We do not buy, sell, breed, board, train, groom, or medically treat animals, and we do not guarantee the existence, quality, health, temperament, pedigree, or legal status of any animal or service advertised. Transactions, contracts, and arrangements are solely between users.
Certain features require you to create an account. You agree to provide accurate, current, and complete information during registration and to update it promptly if it changes. Where we offer verification, you authorise us to take reasonable steps to confirm your identity or eligibility in line with our processes and applicable law.
You are responsible for safeguarding your password and for all activity under your account. You must notify us promptly via our Contact page if you suspect unauthorised access. We may suspend or restrict accounts that appear compromised, fraudulent, or in breach of these Terms.
You may not share your account credentials, sell or transfer your account, or create multiple accounts to circumvent limits, suspensions, or verification requirements, except as we expressly permit.
Dogmarket is intended only for users who are 18 years of age or older. By using the service, you represent and warrant that you meet this requirement. If you are using Dogmarket on behalf of an organisation, you confirm that you are 18+ and authorised to act for that organisation. We do not knowingly collect personal data from minors for this service. If you become aware that a minor has registered, please contact us via the Contact page.
You are solely responsible for the accuracy, legality, and completeness of your listings, photographs, descriptions, pricing, availability, and any communications you send through the platform. You must not misrepresent animals (including breed, age, health status, registration, or lineage), services, credentials, licences, or business details.
You must comply with our Listing Guidelines, these Terms, and all applicable laws, including animal welfare and advertising standards. Without limiting other remedies, we may refuse, edit, hide, or remove any content or listing that we reasonably believe violates these Terms, poses risk to users or animals, or is required to be removed by law or competent authority.
Listings and paid features may be subject to duration, renewal, moderation, and technical limits as described at the point of purchase or in help materials we publish. Where we communicate listing expiry or renewal windows, those communications form part of your practical use of the service.
You acknowledge that Irish law imposes obligations on sellers, breeders, and certain service providers in connection with dogs. You are solely responsible for understanding and complying with all requirements that apply to your activities, including but not limited to:
Dogmarket does not provide legal advice. The list above is illustrative, not exhaustive. If you are unsure of your obligations, consult a qualified adviser or the relevant Irish authorities. We may cooperate with regulators and law enforcement where required.
Payments are processed by Stripe using Stripe Payment Links, Stripe Checkout, and related Stripe services. Your use of Stripe is also subject to Stripe's terms and privacy policy. Dogmarket does not store your full payment card details on our servers.
One-time listing fees (for example, for puppy or adult dog sale listings) are charged as described at checkout. Pricing (including approximate €40 listing fees) may change. The price in force at the time you complete payment applies.
Subscriptions (for example, stud listings or service-provider listings on monthly or yearly plans) renew automatically for successive periods of the same length until cancelled. You authorise Stripe to charge the applicable subscription fees on each renewal in accordance with the plan you select.
You may cancel recurring subscriptions through the Stripe customer billing portal or other cancellation tools we make available. Cancellation stops future renewals. It does not necessarily refund the current period unless applicable law or our stated policy at the time requires otherwise.
Refunds. Fees are generally non-refundable once the service has been supplied or the listing or subscription period has begun, except where mandatory Irish or EU consumer law provides otherwise, where we have charged you in error, or where we elect to offer a refund or credit at our discretion. Chargebacks or payment disputes may result in suspension of your account pending resolution.
Taxes, if any, are your responsibility unless we state otherwise at checkout. If we offer trials or promotions, additional terms will be presented at sign-up.
In connection with Dogmarket, you must not:
We may investigate reports, preserve evidence, and cooperate with authorities where appropriate.
The Dogmarket name, logo, branding, software, text, graphics, layout, and other materials we provide (excluding your content) are owned by Dogmarket or our licensors and are protected by copyright, trade mark, and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the platform for personal or internal business purposes in line with these Terms. You may not copy, modify, distribute, sell, or create derivative works from our materials except as allowed by law or with our prior written consent.
You retain ownership of content you submit. By posting listings, images, forum posts, event details, messages where the feature allows public or semi-public display, and similar materials, you grant Dogmarket a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify (for formatting or technical purposes), display, distribute, and otherwise use such content to operate, promote, and improve the platform, including reasonable archival and backup. You represent that you have all rights necessary to grant this licence.
You are solely responsible for your content and for compliance with law. We may remove or restrict content at any time. Views expressed by users are theirs alone and not ours.
Our collection and use of personal data is described in our Privacy Policy. By using Dogmarket, you acknowledge that we process personal data as set out there.
To the fullest extent permitted by applicable law, Dogmarket and its directors, employees, and contractors provide the platform on an "as is" and "as available" basis. We disclaim all warranties and conditions, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, except any that cannot be excluded under Irish or EU law.
We do not warrant uninterrupted or error-free operation, that defects will be corrected, or that the platform is free of harmful components. We do not endorse, verify, or guarantee any user, listing, message, forum post, or event. You assume all risk arising from interactions with other users and from reliance on information on Dogmarket.
Subject to mandatory Irish and EU law, Dogmarket and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, goodwill, data, or opportunities, arising from your use of the platform or any content or conduct of other users, even if advised of the possibility.
Subject to the same constraint, our aggregate liability for claims arising out of or related to these Terms or the service in any twelve-month period is limited to the greater of (a) the amounts you paid to Dogmarket for the service giving rise to the claim in that period, or (b) one hundred euro (€100), except where a higher minimum applies under law.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable law.
You agree to indemnify, defend, and hold harmless Dogmarket and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your content or listings, your use of the platform, your breach of these Terms or of law, your interactions with other users, or your animals or services advertised. We may assume exclusive defence and control of any matter subject to indemnification, at your expense, and you agree to cooperate.
You may stop using Dogmarket at any time and may request account closure via account tools where available or through our Contact page.
We may suspend or terminate your access, remove or disable content, or refuse service for any reason, including breach of these Terms, risk to users or animals, non-payment, chargebacks, or legal requirement. Where practicable and permitted by law, we may provide notice. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, governing law, and disputes) survive termination.
We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may, where required by law, be communicated through the platform or other reasonable means. Your continued use after the effective date of changes constitutes acceptance, except where your explicit consent is required.
These Terms are governed by the laws of the Republic of Ireland, without regard to conflict-of-law rules that would apply another jurisdiction's laws. Subject to mandatory provisions applicable to consumers, you agree that the Irish courts have exclusive jurisdiction over disputes arising from or relating to these Terms or Dogmarket, except where EU or Irish law requires otherwise.
For questions about these Terms, notices, or complaints, please use our Contact page. We will respond in line with our operational procedures and any legal obligations.
